Federal Judge orders Obama administration to court to explain why it has ignored his immigration injunction
...The Court was first apprised by the Government of the violations of its injunction on May 7, 2015. It admitted that it violated this Court’s injunction on at least 2,000 occasions—violations which have not yet been fixed. This Court has expressed its willingness to believe that these actions were accidental and not done purposefully to violate this Court’s order. Nevertheless, it is shocked and surprised at the cavalier attitude the Government has taken with regard to its “efforts” to rectify this situation.The Government promised this Court on May 7, 2015, that “immediate steps” were being taken to remedy the violations of the injunction. Yet, as of June 23, 2015—some six weeks after making that representation—the situation had not been rectified. With that in mind, the Court hereby sets a hearing for August 19, 2015, at 10:00 a.m. Each individual Defendant must attend and be prepared to show why he or she should not be held in contempt of Court. In addition to the individual Defendants, the Government shall bring all relevant witnesses on this topic as theCourt will not continue this matter to a later date. The Government has conceded that it has directlyviolated this Court’s Order in its May 7, 2015 Advisory, yet, as of today, two months have passed since the Advisory and it has not remediated its own violative behavior. That is unacceptable and,as far as the Government’s attorneys are concerned, completely unprofessional. To be clear, thisCourt expects the Government to be in full compliance with this Court’s injunction. Complianceas to just those aliens living in the Plaintiff States is not full compliance....

The official, who was not authorized to speak publicly about the case and spoke on condition of anonymity, said a police check of the weapon's serial number shows it belonged to a federal agent. The official declined to elaborate further....

Then, they proceeded to turn his house “upside down.”
This story should sound familiar. In April, National Review shared the accounts of three women — Cindy Archer and two others, “Anne” and “Rachel” — who related their own terrifying experiences with dawn or pre-dawn police raids. The police brought a battering ram to Archer’s house, literally watched her dress, and then ran into the bathroom as her partner showered. “Anne” thought for a moment she was facing a home invasion as investigators poured through her front door and screamed taunts in her face. Police followed “Rachel” into the bedrooms where her children slept, where they woke to the sight of armed officers looming over them.
The pretense for the October raids was suspected “coordination” between various conservative organizations and Wisconsin governor Scott Walker’s campaign — activity that a trial court has held constituted nothing more than entirely legal “issue advocacy,” if it even occurred. Because they’d had the temerity to engage in this issue advocacy — constitutionally protected free speech — multiple conservative citizens were subjected to so-called John Doe proceedings by Milwaukee County District Attorney John Chisholm, a Democrat....

Newly obtained documents from the conservative educational foundation Judicial Watch detail an official memo from October 2010 of a meeting between Lois Lerner and officials at the Department of Justice and the FBI to plan for the prosecution of targeted nonprofit organizations.
A lawsuit filed under the Freedom of Information Act produced the documents which included the memo as well as revelations that the Justice Department wanted IRS employees to turn over sensitive documents before giving them to Congress, Judicial Watch said in a press release Tuesday.
In a letter from then-House Oversight Committee Chairman Darrell Issa (R., Calif.) to IRS Commissioner John Koskinen, Issa said “this revelation likely means that the IRS—including possibly Lois Lerner—violated federal tax law by transmitting this information to the Justice Department.”...

This timing is significant because those were the years when the IRS increased its harassment of conservative groups and Wisconsin prosecutors gathered information that would lead to the John Doe probe that officially opened in September 2012. Health insurance companies around the country are seeking rate increases of 20 percent to 40 percent or more, saying their new customers under the Affordable Care Act turned out to be sicker than expected. Federal officials say they are determined to see that the requests are scaled back.
Blue Cross and Blue Shield plans — market leaders in many states — are seeking rate increases that average 23 percent in Illinois, 25 percent in North Carolina, 31 percent in Oklahoma, 36 percent in Tennessee and 54 percent in Minnesota, according to documents posted online by the federal government and state insurance commissioners and interviews with insurance executives....

Did The Department of Justice Get A Gag Order Silencing Reason About The Grand Jury Subpoena?
...Since my June 8 post, I've become convinced that it is likely that there is an under-seal gag order, probably obtained on Thursday, June 4, 2015, purporting to prohibit Reason.com from disclosing the existence of the grand jury subpoena. The U.S. Attorney's Office would have gotten such an order by making an under-seal application to a United States Magistrate Judge under authority discussed below, and obtaining an under-seal order in return. It's impossible to obtain such filings from the courts until the matter is unsealed....
...Third, Reason has now gone ten days without commenting on the story. This story — the federal government using grand jury subpoenas to uncover anonymous commenters — is squarely in Reason's wheelhouse, and would normally provoke justifiable outrage from them. A slight delay in commenting was consistent with them waiting until their lawyers figured out what was going on; this prolonged silence strongly suggests compulsion....

For the past two weeks, Reason, a magazine dedicated to "Free Minds and Free Markets," has been barred by an order from the U.S. District Court for the Southern District of New York from speaking publicly about a grand jury subpoena that court sent to Reason.com.
The subpoena demanded the records of six people who left hyperbolic comments at the website about the federal judge who oversaw the controversial conviction of Silk Road founder Ross Ulbricht. Shortly after the subpoena was issued, the government issued a gag order prohibiting Reason not only from discussing the matter but even acknowledging the existence of the subpoena or the gag order itself. As a wide variety of media outlets have noted, such actions on the part of the government are not only fundamentally misguided and misdirected, they have a tangible chilling effect on free expression by commenters and publications alike....

That scandal was crazy enough, but adding fuel to the fire was the fact that Yee, a Democrat, was also an open supporter of tougher gun control laws and was a proponent of legislation in California to ban the sales of violent video games to children, a law that the Supreme Court subsequently struck down as unconstitutional. Yee was a critic of games like Grand Theft Auto, even though he apparently behaved in real life like one of its characters. He took political hypocrisy to brand new heights....

The cumbersome and time-consuming process of obtaining such authorizations, moreover, would make online communication about certain technical aspects of firearms and ammunition essentially impossible.
Penalties for violations are severe and for each violation could include up to 20 years in prison and a fine of up to $1 million. Civil penalties can also be assessed. Each unauthorized "export," including to subsequent countries or foreign nationals, is also treated as a separate violation....

In the last 7 years of the study, that average increased to 16.4 incidents annually.”
The White House could not possibly have been more pleased with the media reaction to these findings, which were prominently featured by the New York Times, USA Today, CNN, the Washington Post and other major outlets. The FBI report landed six weeks before the midterm elections, and the administration was hoping that the gun-control issue would help drive Democratic turnout.
But late last week, J. Pete Blair and M. Hunter Martaindale, two academics at Texas State University who co-authored the FBI report, acknowledged that “our data is imperfect.” They said that the news media “got it wrong” last year when they “mistakenly reported mass shootings were on the rise.”
Mind you, the authors did not issue this mea culpa in the major news outlets that supposedly misreported the original findings. Instead, the authors published it in ACJS Today, an academic journal published by the Academy of Criminal Justice Sciences. “Because official data did not contain the information we needed, we had to develop our own,” wrote Messrs. Blair and Martaindale. “This required choices between various options with various strengths and weaknesses.” You don’t say....

A number of videos and recordings emerged last year showing Gruber’s disdain for the “stupidity of the American voter,” and expounding on the “huge political advantage” the administration had because Obamacare was passed with little transparency — leading the administration to distance itself from the professor. ...
...Gruber was in contact with key advisers on the health-care law, including Peter Orszag, then-director of the Office of Management and Budget; Jason Furman, then an economic adviser to the president who is now chairman of the president’s Council of Economic Advisers; and Ezekiel Emanuel, then a special adviser for health policy at OMB.
“Thank you for being an integral part of getting us to this historic moment,” Jeanne Lambrew, a top administration official at HHS and the White House, wrote to Gruber in September 2009. In another email several months later, she hailed Gruber as “our hero.”
Far from being an independent contractor, Gruber regularly consulted with Lambrew when answering questions about his relationship with the Obama administration. Gruber went to Lambrew for advice when a Politico reporter asked why he had not disclosed his administration contract before writing about health care policy, and asked Lambrew to review his description of his own responsibilities at HHS before responding. Gruber also spoke to top HHS officials about his interviews with other reporters, including one with Ezra Klein, then at the Washington Post....

That’s a huge range, from marginally beneficial to terrifyingly harmful, so it is hardly a consensus of danger, and if you look at the “probability density functions” of climate sensitivity, they always cluster towards the lower end.
What is more, in the small print describing the assumptions of the “representative concentration pathways”, it admits that the top of the range will only be reached if sensitivity to carbon dioxide is high (which is doubtful); if world population growth re-accelerates (which is unlikely); if carbon dioxide absorption by the oceans slows down (which is improbable); and if the world economy goes in a very odd direction, giving up gas but increasing coal use tenfold (which is implausible).
But the commentators ignore all these caveats and babble on about warming of “up to” four degrees (or even more), then castigate as a “denier” anybody who says, as I do, the lower end of the scale looks much more likely given the actual data. This is a deliberate tactic. Following what the psychologist Philip Tetlock called the “psychology of taboo”, there has been a systematic and thorough campaign to rule out the middle ground as heretical: not just wrong, but mistaken, immoral and beyond the pale. That’s what the word denier with its deliberate connotations of Holocaust denial is intended to do. For reasons I do not fully understand, journalists have been shamefully happy to go along with this fundamentally religious project....

The climate stations use three independent measurements of temperature and precipitation to provide “continuity of record and maintenance of well-calibrated and highly accurate observations,” NOAA states on its website. “The stations are placed in pristine environments expected to be free of development for many decades.” In essence, NOAA chose locations so they don’t need to be adjusted for “biases” in the temperature record.

In other words, the government that killed Osama bin Laden is only slightly more popular than the country that harbored him. No wonder government employees have low self-esteem....

Scientists May Have Lied To Promote EPA’s Global Warming Agenda
Scientists may have lied about the EPA’s involvement in a recent study put out earlier this year claiming Obama administration regulations on carbon dioxide emissions will save thousands of lives every year.
Emails obtained by the blog JunkScience.com’s Steve Milloy show Harvard University and Syracuse University researchers involved in the study consulted with the EPA while conducting their study, contradicting their previous statements the study was done independently of the agency....
The 97% Cook Consensus – when will Environ Res Letters retract it?
...As Tol explains, the Cook et al paper used an unrepresentative sample, can’t be replicated, and leaves out many useful papers. The study was done by biased observers who disagreed with each other a third of the time, and disagree with the authors of those papers nearly two-thirds of the time. About 75% of the papers in the study were irrelevant in the first place, with nothing to say about the subject matter. Technically, we could call them “padding”. Cook himself has admitted data quality is low. He refused to release all his data, and even threatened legal action to hide it. (The university claimed it would breach a confidentiality agreement. But in reality, there was no agreement to breach.) As it happens, the data ended up being public anyhow. ...
...The hidden timestamps of raters revealed one person rated 675 abstracts in 72 hours, with much care and lots of rigor, I’m sure. It also showed that the same people collected data, analyzed results, collected more data, changed their classification system, and went on to collect even more data. This is a hopelessly unscientific process prone to subjective bias and breaches the most basic rules of experimental design. Tol found the observations changed with each round, so the changes were affecting the experiment. Normal scientists put forward a hypothesis, design an experiment, run it, and then analyze. When scientists juggle these steps, the results influence the testing. It’s a process someone might use if they wanted to tweak the experiment to get a specific outcome. We can’t know the motivations of researchers, but there is a reason good scientists don’t use this process....

This is a hopelessly unscientific process prone to subjective bias and breaches the most basic rules of experimental design. Tol found the observations changed with each round, so the changes were affecting the experiment. Normal scientists put forward a hypothesis, design an experiment, run it, and then analyze. When scientists juggle these steps, the results influence the testing. It’s a process someone might use if they wanted to tweak the experiment to get a specific outcome. We can’t know the motivations of researchers, but there is a reason good scientists don’t use this process....

And no one knows if the five cents is a result of discrimination or some other subtle, hard-to-measure difference between male and female workers. In its fact-checking column on the State of the Union, the Washington Post included the president’s mention of the wage gap in its list of dubious claims. “There is clearly a wage gap, but differences in the life choices of men and women… make it difficult to make simple comparisons.”...

...A review of foundation disclosures shows that at least two foreign governments — Germany and the United Arab Emirates — began giving in 2013 after the funding restrictions lapsed when Clinton left the Obama administration. Some foreign governments that had been supporting the foundation before Clinton was appointed, such as Saudi Arabia, did not give while she was in office and have since resumed donating.
Foundation officials said last week that if Clinton runs, they will consider taking steps to address concerns over the role of foreign donors.
“We will continue to ensure the Foundation’s policies and practices regarding support from international partners are appropriate, just as we did when she served as Secretary of State,” the foundation said in a statement.
Foreign governments had been major donors to the foundation before President Obama nominated Clinton to become secretary of state in 2009. When the foundation released a list of its donors for the first time in 2008, as a result of the agreement with the Obama administration, it disclosed, for instance, that Saudi Arabia had given between $10 million and $25 million....
...In Algeria and Tunisia, rapists can avoid prosecution for raping minors if they marry their victims thanks to Article 326 of the Algerian Penal Code and Article 227 of the Tunisian Penal Code. And thanks to the penal code in Morocco, the severity of punishment for rape depends on whether the woman was a virgin or not. In all three countries, marital rape is not recognized as an offense, and both same-sex sexual relations and consensual extramarital relations are illegal, which can discourage survivors from reporting assaults, for fear they will be in legal trouble themselves.
These legal provisions impede justice for survivors and continue to facilitate incidents of sexual violence, leaving survivors of rape and sexual assault without justice or hope. In March 2012 in Morocco, 16 year-old Amina Filali swallowed rat poison and killed herself after she was forced to marry her rapist. No one should face a lifetime with her rapist, just as no one’s virginity “status” should determine justice.
For these reasons, Amnesty has selected the Maghreb region as a focus area in its My Body, My Rights campaign, a global campaign to help ensure everyone has access to their sexual and reproductive rights and enjoys the full spectrum of rights over their bodies.
All people have the right to live in safety. All people have the right to make their own decisions about their bodies, including whether to have children, when to marry, and when and with whom to engage in sexual relations, and the governments of Morocco, Algeria, and Tunisia must amend discriminatory legislation that gives offenders impunity....

A new study out of the United Kingdom predicts the Earth is about to go through a major climatic shift that could mean decades of cooler temperatures and fewer hurricanes hitting the United States.
Scientists at the University of Southampton predict that a cooling of the Atlantic Ocean could cool global temperatures a half a degree Celsius and may offer a “brief respite from the persistent rise of global temperatures,” according to their study....

NYT, Boston Globe Both Report That Different Structures of the Clinton Foundation Deliberately Hid Money
...Aides to former President Bill Clinton helped start a Canadian charity that effectively shielded the identities of donors who gave more than $33 million that went to his foundation, despite a pledge of transparency when Hillary Rodham Clinton became secretary of state. The nonprofit, the Clinton Giustra Enterprise Partnership (Canada), operates in parallel to a Clinton Foundation project called the Clinton Giustra Enterprise Partnership, which is expressly covered by an agreement Mrs. Clinton signed to make all donors public while she led the State Department. However, the foundation maintains that the Canadian partnership is not bound by that agreement and that under Canadian law contributors’ names cannot be made public.
The foundation cited that restriction last weekend in explaining why it did not disclose $2.35 million in donations from the chairman of Uranium One, the subject of an article in The New York Times last week....
"This is hardly an effort on our part to avoid transparency," said Maura Pally, acting chief executive of the Clinton Foundation, as she took new efforts to avoid transparency....

BUSTED: Paul Krugman removed 20 years of data from a chart to show a correlation that wasn't really there
...The period in the early 1960's was removed, and so was the period from 2000 on. In other words, out of a 55-year time period, Dr. Krugman decided to remove 20 years' worth of data. For those keeping track, that's removing almost 40% of an entire data set just because the data didn't fit the narrative. And when you add those years back you get a result that shows a very weak correlation...

The question relates to the Journal-Sentinel reporters’ knowledge of a pre-dawn paramilitary-style raid of the home of Cindy Archer, a fomer aide to Wisconsin Governor Scott Walker and one of the architects of Wisconsin’s Act 10, which reformed that State’s public sector unions.
The raid of Archer’s home occurred in the early morning hours of Wednesday, September 14, 2011. At the time of the raid, Archer saw an individual that she believed to be a reporter, standing in her lawn. But the question became: How would a reporter even know that Archer’s home was being raided? Someone had to tip the Journal-Sentinel off. But under Wisconsin law, disclosure of a search warrant’s issuance, prior to its execution, is a Class I felony and could also violate the judge’s secrecy order of the John Doe investigation itself....

Now, the administration will not let states even ask people to establish they are citizens when they register to vote.
That’s the underlying plot in the latest major case in election law that has just been presented to the Supreme Court. Federal law says that states must accept and use a federal form for registering voters. But the federal form doesn’t require any proof that the person submitting the form is a citizen.
The form just asks the registrant to check a box...

Dec. 16 (Bloomberg) -- Daniel Mudd, the former chief executive officer of Fannie Mae, and Richard Syron, ex-CEO of Freddie Mac, were sued by the U.S. Securities and Exchange Commission for understating by hundreds of billions of dollars the subprime loans held by the firms.
The lawsuits filed today in Manhattan federal court were followed by an SEC statement that it had entered into “non-prosecution agreements” with each company. Fannie Mae, the government-sponsored enterprise which issues almost half of all mortgage-backed securities, and Freddie Mac, the McLean, Virginia-based mortgage-finance company, had “agreed to accept responsibility” for their conduct, the SEC said.
The agency said in the lawsuits that Syron, Mudd and other executives understated exposure to subprime mortgage loans. From 2007 to 2008, Freddie Mac executives said the company’s exposure was from $2 billion to $6 billion when it was actually as high as $244 billion, according to one SEC complaint.
From 2006 to 2008, Washington-based Fannie Mae executives said the firm’s exposure to subprime mortgage and reduced-documentation loans was about $4.8 billion when it was almost 10 times greater, according to the regulator....
In 2004, before Fannie Mae pushed into riskier loans, the Department of Housing and Urban Development suggested the definitions were becoming fuzzy.
"As the GSE's become more comfortable with subprime lending, the line between what today is considered a subprime loan versus a prime loan will likely deteriorate, making expansion by the GSE's look more like an increase in the prime market," the housing department said in a November 2004 report.

Former UN Lead Author: Global Warming Caused By ‘Natural Variations’ In Climate
Global temperature change observed over the last hundred years or so is well within the natural variability of the last 8,000 years, according to a new paper by a former Intergovernmental Panel On Climate Change (IPCC) lead author.
Dr. Philip Lloyd, a South Africa-based physicist and climate researcher, examined ice core-based temperature data going back 8,000 years to gain perspective on the magnitude of global temperature changes over the 20th Century.
What Lloyd found was that the standard deviation of the temperature over the last 8,000 years was about 0.98 degrees Celsius– higher than the 0.85 degrees climate scientists say the world has warmed over the last century....

...In his latest article, Sterling wrote that Switzerland’s weather bureau adjusted its raw temperature data so that “the temperatures reported were consistently higher than those actually recorded.” For example, the cities of Sion and Zurich saw “a doubling of the temperature trend” after such adjustments were made....
...The Swiss affair, however, is not the first instance of data “homogenization” catalogued by scientists and researchers who are skeptical of man-made global warming. In January, skeptic blogger Paul Homewood documented how NASA has “homogenized” temperature data across Paraguay to create a warming trend that doesn’t exist in the raw data....
...Before that, the Australian Bureau of Meteorology (ABM) was forced to admit it adjusts temperatures recorded at all weather stations across the country. Aussie journalists had been critical of ABM for being secretive about its data adjustments....
